This Privacy Policy (the “Policy”) informs you of your rights and how your personal information is collected, stored and further processed in connection with the provision of services by the BIDLI Group.

1. General provisions

The purpose of this Privacy Policy for Users issued by the BIDLI Group, as defined below, pursuant to Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”), is to provide information on , what personal data does the BIDLI group collect, store and process about natural persons who are in the position of potential customers, customers and their representatives, including members of statutory and other bodies, and website visitors, for what purposes and for how long this personal data In accordance with the valid legal regulations, we process to whom and for what reason we can transfer them, and also inform about the rights of natural persons in connection with the processing of their personal data.

This Policy applies to the processing of BIDLI Group customer data and visitors to our website (hereinafter referred to as “Customers” or “You”), which we have obtained either through our website, directly from you or from third parties, always to the extent of personal data corresponding to their position vis-à-vis the BIDLI group.

This Policy is effective as of May 25, 2018 and is issued in accordance with the GDPR in order to ensure our information obligation as a trustee under the GDPR.

I hereby inform you that as a data subject, you are entitled to exercise all rights under this Policy to each member of the BIDLI group and to each of them.

3. Categories of personal data processed by the BIDLI group

Personal data is any information that relates to a natural person that we are able to identify you. In connection with the legal relationship between you and us, the following categories of personal data may be processed.

3.1 Basic personal identification data

These are such data that are necessary for the conclusion and performance of the contract and are in particular the following personal data:

academic title;

name and surname;

permanent address; and

birth number or date of birth;

3.2 Contact details

These are the following personal data:

e-mail;

telephone number; and

mailing address.

3.3 Data related to the provided service

These are the following personal data:

payment details and bank details; and

possibly other necessary data.

3.4 Data on communication with you

This data is generated during communication related to the provision of services by the BIDLI Group. It involves written and electronic communication with the customer and records of telephone calls.

4. Purpose, time and legal reason for processing personal data

4.1 Processing due to the performance of the contract, the fulfillment of legal obligations and due to a legitimate interest

4.1.1 Processing of personal data in fulfillment of the contractual obligation

The BIDLI Group obtains and processes your personal data for the purpose of providing services and concluding a contract that is or will be concluded between you and us, where the legal title of the processing is therefore the performance of the contract. For these purposes, personal data are processed in the scope of basic personal identification data, contact data and data related to the provided service.

This personal data is processed by us only for the duration of the contractual relationship between you and us, after its termination only if required by law or our legitimate interest.

4.1.2 Processing of personal data in fulfillment of legal obligations

When providing services, we are obliged to fulfill the obligations arising from the following legal regulations, namely Act No. 563/1991 Coll., On Accounting (hereinafter referred to as the “ZoÚ”); Act No. 586/1992 Coll., on Income Taxes (hereinafter referred to as “ITA”) and Act No. 235/2004 Coll., on Value Added Tax (hereinafter referred to as “VAT”) and pursuant to Act No. 253/2008 Sb. on certain measures against money laundering and terrorist financing (“AML”).

Some personal data may be stated on accounting documents (ie invoices or other documents), as well as on contracts or contractual documents in connection with Real Estate Mediation. The following laws of the ZoÚ, ZDP or ZDPH and AML require us to keep these documents for up to 10 years. Therefore, if we have a legal obligation to archive these documents, your personal data listed on the relevant tax document or contractual documents are stored together with them.

4.1.3 Processing of personal data on the basis of a legitimate interest

4.1.3.1 Contact details

We obtain and process your contact details also on the basis of a legitimate interest, in the event that your personal data is published on the relevant real estate and other portals. We obtain this personal data either directly from the relevant portal or from a third party who monitors these portals. This data is processed by us for the period for which you publish this data, or until you express your disagreement with such processing on your part.

4.1.3.2 Telephone records

We record telephone calls with our customers in order to improve the services offered by the BIDLI group. Records are kept only electronically, for a maximum of 3 days, or for the duration of the investigation of a specific telephone record in a situation where there is a suspicion that damage, misdemeanor, criminal offense or other legitimate reason has been caused.

4.1.2.3 Enforcement of the obligation

In the event that we incur other damage or harm on your part, we may also process your personal data on the basis of a legitimate interest in the recovery of our claims and / or the determination, protection and enforcement of our legal claims. For this purpose, we may store your personal data for the period of the limitation period according to Act no. 89/2012 Coll., Civil Code.

4.1.4 Processing on the basis of your consent

4.1.4.1 Marketing communication

If you consent to the processing of personal data, we will use your personal data to send you news about our services, marketing offers and other commercial communications related to the services provided by the BIDLI Group.

Personal data processed in this way are collected in the range of: e-mail, name and surname and telephone number.

The above data will be kept for 5 years from the date of consent. You can revoke your consent at any time. Withdrawal of consent only works in the future and is therefore without prejudice to the lawfulness of prior processing based on this consent.

4.1.5 Cookies

5. To which third parties do we pass on personal data

We process the personal data you provide to us within the BIDILI group. If the processing of personal data is based on your consent or on the legitimate interests and purposes listed above, your personal data may be processed by third parties that the BIDLI Group uses to provide professional and specialized services. If these persons process personal data transmitted by us, they process them only within the instructions of us and may not use them otherwise. At the same time, they provide guarantees by which they ensure the technical and organizational protection of the personal data transmitted by us, in the form of a contract on the processing of personal data.

In the sense of the above, we may, in our legitimate interest, provide your personal data to the following entities:

Companies within the BIDLI group;

IT system and support vendors who may, in certain cases, have access to your personal information; and

external lawyers, if necessary for the recovery of receivables or for the protection of our legitimate interests and the audit firm.

We have concluded personal data processing agreements with personal data processors, which guarantee at least the same level of protection for your personal accounts

As part of the fulfillment of its legal obligations, the company also transmits your personal data to public authorities on the basis of an obligation stipulated by law.

6. Security of personal data

We have put in place and maintain the necessary appropriate technical and organizational measures, internal controls and information security processes in accordance with the best care of you and with respect to your rights, commensurate with the potential risk involved as a data subject. At the same time, we take into account the state of technological development in order to protect personal data from accidental loss, destruction, alteration, unauthorized disclosure or access. These measures may include, but are not limited to, taking reasonable steps to ensure the accountability of employees who have access to personal data and documents, employee training, regular backups, data recovery and incident management procedures, software protection of personal data storage devices, and more. .

7. Your rights to personal data

If you exercise any of your rights under this Article 7 of the Policy or under applicable law, we will notify you of any action taken or deletion of your personal data or processing restrictions in accordance with your request by any recipient to whom such data has been provided under Article 5 of this Policy, such communication will be possible and / or will not require disproportionate effort.

If you exercise your rights, we may ask you to provide some of the identifying information you have provided to us. The provision of such information is necessary to verify that the relevant request has actually been sent by you. We have a 30-day statutory period to settle your request, but we reserve the right to extend this period by two months.

7.1 Right of access to personal data

According to Article 15 of the GDPR, you have the right to access your personal data, which includes the right to obtain from us:

confirmation of whether we process your personal data,

information about the purposes of the processing, the categories of personal data concerned, the recipients to whom the personal data were or will be made available, the planned processing time, the existence of the right to request correction or deletion of personal data relating to your personal data or restrictions on their processing or to object to this processing, the right to complain to the Authority, of all available information on the source of personal data, if not obtained from the data subject, of the fact that automated decision-making, including profiling, takes place, of appropriate safeguards for data transfers outside the EU,

provided that the rights and freedoms of others are not adversely affected, as well as a copy of personal data.

In the event of a repeated request, we are entitled to charge a reasonable fee for a copy of personal data.

7.2 Right to correct inaccurate data

Pursuant to Article 16 of the GDPR, you have the right to correct inaccurate personal data that we process about you. You are also required to notify changes to your personal information and to demonstrate that such a change has occurred. At the same time, you are obliged to provide us with cooperation if it is found that the personal data we process about him is not accurate. We will carry out the repair without undue delay, but always with regard to the given technical possibilities.

7.3 The right to delete personal data

Pursuant to Article 17 of the GDPR, you have the right to delete personal data concerning you, unless we prove legitimate reasons for the processing of such personal data. We have mechanisms in place to ensure automatic anonymization or deletion of personal data if they are no longer needed for the purpose for which they were processed.

7.4 The right to restrict processing

According to Article 18 of the GDPR, the data subject will have the right to limit the processing until the complaint is resolved, if he denies the accuracy of the personal data, the reasons for their processing or if he objects to their processing.

7.5 The right to the portability of personal data

Pursuant to Article 20 of the GDPR, you have the right to the portability of the data concerning you which you have provided to us, in a structured, commonly used and machine-readable format. At the same time, you have the right to ask us to pass this data on to another administrator.

In the event that the exercise of this right could adversely affect the rights and freedoms of third parties, your request cannot be granted.

7.6 The right to object to the processing of personal data

Pursuant to Article 21 of the GDPR, you have the right to object to the processing of your personal data by the BIDLI Group.

If we do not prove the existence of a serious legitimate reason for the processing, which outweighs the interests or rights and freedoms of the data subject, we will terminate the processing on the basis of the objection without undue delay.

7.7 The right to withdraw consent to the processing of personal data

If you give us consent to the processing of personal data, it is possible to revoke it at any time after this date. The appeal must be made an explicit, comprehensible and definite expression of will, either in writing to our contact delivery address or via the e-mail address compliance@bidli.cz.

7.8 The right to contact the Office for Personal Data Protection
